Content Use Policy

If you are a Teach, Learn, Grow - Physical Education user, this is the document that clarifies what you are allowed to do with the content found in the Teach, Learn, Grow - Physical Education portal and what you are not allowed to do with it. We will ask you to expressly agree to the rules set out in this Policy. If you do then you will be unable to use Teach, Learn, Grow - Physical Education.

1. Definitions and interpretation
   "Customer" means the customer specified in the Statement of Services;
   "Content" means any data, text, pictures, videos, photos and resources contained within the Teach, Learn, Grow - Physical Education platform;
   "Paid Plan" means the length of time during which the Customer pays and has access to the Platform;
   "Platform" means the software platform known as Teach, Learn, Grow - Physical Education that is owned and operated by the Provider, and that will be made available to the Customer as a service via the internet under the Agreement;
   "Provider" means TLG-PE Limited, a company incorporated in England and Wales (registration number 07898758) having its registered office at Kingfisher House, 140 Nottingham Road, Long Eaton, Nottingham, NG10 2EN;
2. Content ownership
   All content or parts thereof are owned by and copyrighted by TLG-PE Limited. Unless otherwise specified in the Contract TLG-PE Limited's content is leased to the Buyer for the duration of their Teach, Learn, Grow - Physical Education usage only and no intellectual property rights of any content shall pass to the Buyer under the Contract. The content must not be copied or recorded by the Buyer or its Agents, or in any way processed by the Customer or its Agents other than in accordance with the Contract or as agreed in writing by TLG-PE Limited. Content supplied must, in no circumstances, be offered for resale by the Customer.
3. Supply and Use of the Content
   a) In the event of a breach of content usage by the Buyer, i.e. where it is determined by TLG-PE Limited that the content has been used by the Buyer outside of the usage terms as specified in these Conditions, a re-use charge of 100% of the value of the annual cost of the plan from which the data was exported/copied will be imposed per occasion of each breach and payable within 7 days by the Customer.
   b) All content that can be removed from the platform by the customer will be in the format of a PDF or will have a print icon available.
   c) Assessment content can be printed from the platform, by the customer, at any time.
   d) If the Buyer chooses to not renew their Teach, Learn, Grow - Physical Education plan any content previously entered onto the platform by the customer may be exported by them prior to the end of the contract.
4. Content Accuracy
   a) TLG-PE Limited uses all reasonable endeavors to ensure content is accurate and up-to-date.
   b) The provider will continue to add content to the platform inline with amendments and changes to the National Curriculum.
5. Liability
   TLG-PE Limited does not accept liability for the outcome of the use of its content. In no event will TLG-PE Limited be liable for any decline in performance, or other indirect or consequential loss of any kind in contract, tort (including negligence) or otherwise arising out of use of its content, save where such liability cannot be excluded by law.
6. Buyer's obligations
   The Buyer:-
   a) agrees to notify TLG-PE Limited of any amendments to school roll which requires children to be added to/removed from the school database.
   b) agrees to notify TLG-PE Limited if any content is found to be out of date or incorrect.
